NEWS RELEASE SUNDAY 5 AUGUST 2007 FOR IMMEDIATE RELEASE From Bob Egerton (Bank charges campaigner known as Bob the Bankbuster) BANK CHARGES CAMPAIGNER CALLS FOR ALL CLAIMS BY BANKS AGAINST THEIR CUSTOMERS TO BE PUT ON HOLD PENDING THE OFT TEST CASE Following the decision by the Judiciary to put on hold all claims by bank customers for refunds of penalty charges, pending the OFT test case, Bob Egerton, bank charges campaigner, has called for the same to be done where banks are suing their customers. In the first half of 2007, Britain's high street banks paid out several hundred million pounds to customers seeking refunds for alleged unlawful penalty charges. On 27 July, the OFT announced that it would be taking several banks to court to obtain a ruling on the legality of these charges. At the same time, the FSA and Financial Ombudsman announced that they would be suspending all complaints against banks on this issue. Shortly thereafter, the Judiciary put into action a plan to put on hold all claims in the court system. Thus, the banks, having failed to stop the most successful consumer grass roots campaign ever, have been given a breathing space of several months, if not years, by the Judiciary. Bank campaigners have reacted with outrage to this move and many have made it clear that they will contest individual cases in the court and apply to have the stays lifted. Bob Egerton, who has a 100% success rate in claims for his clients and has personally recovered over £300,000 for them, has written to the Deputy Head of Civil Justice requesting that he issue an invitation to county court judges to stay all claims by banks against their customers. Bob said, "Whenever a bank sues a customer because of their indebtedness, a large element of the claim is likely to comprise an accumulation of penalty charges imposed on the customer's account. It would be outrageous if the banks were allowed to continue with these claims unhindered by the OFT test case whilst, at the same time, the customer is debarred from claiming the penalties back from the bank. That is why I have written to the Judiciary. What is sauce for the goose should be sauce for the gander. Meanwhile, I recommend that anyone who is being sued by their bank should go to court and ask for a hold to be put on their case."
